1. Agreement to Terms

By accessing our website at https://sofynexglobal.com or hiring Sofynex Global ("Company", "we", "us") for website development, custom software engineering, e-commerce, or mobile application services, you agree to be bound by these Terms of Service. If you do not agree with any of these terms, you are prohibited from using our site and services.

2. Services Scope & Quotations

Sofynex Global delivers IT and web development services outlined in mutually agreed proposals or invoices.

• Project scope, milestones, deliverables, and estimated timelines will be detailed in the project agreement.
• Any feature request outside the initial project scope will incur additional charges based on standard hourly/project rates.

3. Payments & Pricing

Our payment structure operates as follows:

• Advance Deposit: Projects require an advance upfront payment (as specified in the quote) before initial setup or design work begins.
• Milestone Payments: Remaining project balances must be cleared according to milestone completion dates or prior to final project deployment to the client's live domain/server.
• Non-Refundable Policy: Payments made for work already completed, design mockups created, or third-party server/domain purchases are non-refundable.

4. Intellectual Property Rights

Upon receipt of full and final payment for the project:

• The client holds full ownership of the final website/application source code, graphics, and custom media content created specifically for their project.
• Sofynex Global reserves the right to display completed client projects in portfolio showcases, case studies, or marketing materials unless an NDA (Non-Disclosure Agreement) is explicitly signed.

5. Client Content & Responsibilities

Clients are solely responsible for supplying necessary project text, images, logos, API access credentials, and content in a timely manner. Delays in providing content will extend overall project delivery timelines. The client guarantees that all provided materials do not infringe upon third-party copyrights or trademark laws.

6. Maintenance, Support & Warranties

We provide free post-launch support for 30 days to resolve software bugs or technical glitches related to the initial project scope. Ongoing updates, third-party server downtime, hosting renewals, or client-induced errors beyond 30 days are subject to maintenance agreements.

7. Limitation of Liability

Sofynex Global shall not be liable for indirect, incidental, or consequential damages, including loss of revenue, server outages caused by third-party web hosts, security breaches on unmaintained external systems, or data loss resulting from unauthorized client access.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of India. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts located in Lucknow, Uttar Pradesh.
